Terms of Service

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and that you have the authority to agree to these Terms. If you are under the age of legal adulthood where you live, your parent or guardian must review and agree to these Terms and supervise your use. Any higher minimum age required by applicable law also applies.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it up to date.

3. User Content

You retain ownership of the highlights, posts, comments, and other content you submit to the App ("User Content"). By posting User Content, you grant Merq a license that is not exclusive, is worldwide, and requires no royalty payments to host, store, reproduce, and display that content solely to operate and improve the App. You are responsible for your content and confirm you have the rights necessary to share it.

4. Player Ratings & Community Conduct

The Run Together rating system and community features are intended to help players find trustworthy teammates. Ratings and reviews must be honest and based on genuine interactions. Harassment, hate speech, cheating, impersonation, and abuse of the rating system are prohibited and may result in content removal or account suspension.

5. Prohibited Conduct

• Violating any applicable law or the rights of another party.
• Posting unlawful, harassing, defamatory, or sexually explicit content.
• Interfering with or gaining unauthorized access to the App or its systems.
• Using the App to spam, scam, or impersonate another person.

6. Paid Features

Real money purchases, purchased point gifting, and creator payouts have not launched. Restricted owner sandbox tools simulate purchases, gifts, earnings, and payouts. Test points and test balances are separate from the app wallet, have no cash value, and cannot be redeemed for real money. A successful test does not enable a live service or create a right to payment.

Before a paid feature becomes available, Merq will present its price, taxes where applicable, supported purchase channel, and applicable purchase and refund terms. Merq Points are digital units for supported features, not a bank deposit or a fixed dollar claim. Points received as gifts do not by themselves establish creator cash earnings. Any future creator earnings depend on eligible purchase funding, reviewed expenses, and the Creator Earnings Terms, including the creator acceptance required before live participation.

Website payments and native app purchases are separate purchase channels. Availability in one does not mean another is enabled. Apple Pay as a payment option is not the same as an App Store in app purchase. See our Refund Policy for charge support, sandbox information, and the rules that must be presented before launch. Nothing in these Terms limits consumer rights that cannot lawfully be excluded.

7. Termination

We may suspend or terminate your access if we believe you have violated these Terms. You may stop using the App and delete your account at any time.

8. Disclaimers & Limitation of Liability

The App is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Merq will not be liable for indirect, incidental, or consequential damages arising from your use of the App.

9. Changes to These Terms

We may update these Terms from time to time and will identify the updated date here. We will provide notice of material changes through the App or another appropriate channel. Where a change requires your express agreement, including the creator financial terms required for live enrollment, we will request that agreement before enabling the affected feature. Visiting a policy page or using a sandbox does not record acceptance of live creator financial terms.
